TEXAS LIABILITY RELEASE & ASSUMPTION OF RISK

By renting equipment from WhitElegance Party Rentals, Customer acknowledges and agrees that the use of inflatable amusement equipment, including bounce houses, water slides, obstacle courses, and related equipment, involves risks of injury, property damage, illness, or death. Customer knowingly and voluntarily assume all risks associated with the use of the rented equipment by customer, customer's guests, invitees, participants, and any minors under customer's supervision.
To the fullest extent permitted by Texas law, customer release, waive, and discharge WhitElegance Party Rentals, its owners, officers, employees, contractors, agents, and representatives from any claims, demands, causes of action, damages, costs, expenses, or liabilities arising from the use of the rented equipment, including claims arising from ordinary negligence.
This release does not apply to gross negligence, reckless conduct, or intentional misconduct where prohibited by law.
CUSTOMER RENTAL AGREEMENT
By renting equipment from WhitElegance Party Rentals, the Customer agrees to the following terms and conditions:
1. Assumption of Risk
The Customer understands that inflatable bounce houses, water slides, obstacle courses, and related rental equipment involve inherent risks of injury, including but not limited to:

Falls
-
Collisions
-
Slips
-
Trips
-
Entrapment
-
Equipment misuse
-
Weather-related incidents
The Customer voluntarily assumes all risks associated with the use of the rented equipment.
2. Adult Supervision Required
The Customer agrees that:

A responsible adult (18 years or older) must supervise the inflatable at all times during operation.

The inflatable shall never be left unattended while in use.
-
The supervisor is responsible for enforcing all safety rules.
3. Safety Rules
The Customer agrees to enforce the following rules:

No shoes inside the inflatable.
-
No food, drinks, gum, candy, or confetti.
-
No sharp objects.
-
No roughhousing, wrestling, flips, or horseplay.
-
No climbing on walls, netting, or exterior surfaces.
-
Users should be grouped by similar age and size.
-
Do not exceed manufacturer capacity limits.
-
Do not use during high winds, lightning, heavy rain, or unsafe weather conditions.
4. Equipment Care
Customer agrees to:

Maintain the equipment in good condition.
-
Keep pets away from the inflatable.
-
Prevent damage from fire, grills, cigarettes, fireworks, face paint, silly string, markers, paint, or sharp objects.

Notify the company immediately of any damage or operational issues.
Customer accepts responsibility for damage caused by negligence, misuse, vandalism, or failure to follow safety instructions.
5. Weather Policy
For safety reasons:

Equipment shall not be used during severe weather conditions.
-
[BUSINESS NAME] reserves the right to cancel or reschedule rentals due to unsafe weather.

Refund and rescheduling policies are subject to company guidelines.
6. Release of Liability
The Customer, on behalf of themselves and all participants, releases, waives, discharges, and agrees to hold harmless [BUSINESS NAME], its owners, employees, contractors, and affiliates from any and all claims, liabilities, damages, injuries, losses, costs, or expenses arising from:

Use of rental equipment

Participation in activities involving rental equipment

Property damage
-
Personal injury
-
Death
-
Negligence of participants or third parties
except where prohibited by law.
7. Indemnification
Customer agrees to defend, indemnify, and hold harmless [BUSINESS NAME] against any claims, lawsuits, damages, losses, attorney fees, or liabilities arising from:

Improper use of equipment
-
Failure to supervise participants
-
Violation of safety rules
-
Damage to equipment
8. Delivery & Setup
Customer agrees that:

Delivery personnel will determine safe placement of equipment.
-
Equipment may not be moved after setup.
-
Customer must provide adequate access, space, and electrical supply.

Customer is responsible for obtaining any required permits or HOA approvals.
